RENTAL POLICY & AGREEMENT

Elevate The Cake rentals are for 3 days with the exception of Throne Chairs, which are one-day rental items (unless payment for additional days has been made).  Rentals picked up by 5 pm on Friday must be returned by 5 pm Monday.  Rental items not returned by 5 pm at the end of the rental period will be charged a $25 fee for each day the rental is late.  Orders and payments must be placed no later than 24-36 hours before the date needed.  This enables Elevate The Cake Staff to have your order prepared for delivery or pick up.  Same-day orders are subject to approval.

SECURITY DEPOSITS

All rentals are subject to a security deposit for any damage, late returns, or no return of the item(s) that were rented from Elevate The Cake. The Security deposit hold will be released after the inspection of rental items. Items returned damaged or not returned on time or at all are subject to fees for items ranging from $25 to $750 to repair or replace items that are the property of Elevate The Cake and were damaged while being rented by the client. The client is responsible for any damage incurred. Photos and clear explanations will be given to the client prior to the security deposit being enforced. We release our product in proper condition for your usage, we expect to receive our product in the same condition when returned. The security deposit will be enforced!


DELIVERY
Elevate The Cake will deliver for FREE within a 5-mile radius.   Delivery and pickup must be at the same location, unless, a safe alternative location has been determined by the renter and Elevate The Cake.  The renter must make sure that the rental item is ready for pickup when Elevate The Cake arrives.  The pickup location must not be further in mileage than the original drop off location or an additional fee will be incurred. 
•    6-25 miles - $40 (Delivery & Pick Up)
•    26-50 miles - $50 (Delivery & Pick Up)


Elevate The Cake will deliver & pick up for FREE any rental orders over $350 within a 35-mile radius.  Adult Throne Chairs MUST be delivered and picked up by Elevate The Cake.
All rental items, containers, and packing materials must be returned with your order, or fees will be incurred. Items must be gathered and ready for loading following the event. Delivery includes drop-off on Friday and pick-up on Monday (based on weekend rental).  Items must be stored indoors, in a secure location until pick-up. 


If items are not available or accessible upon arrival for pick-up, another day's rental fee as well as pick-up fee will be incurred due to multiple trips. The renter may return the items but the delivery fee is not refundable after Elevate The Cake has attempted to pick up rentals.  If the renter wants to re-schedule another pick-up time after the return date, a late fee as well as an additional delivery/pickup fee will be incurred.  If you, the renter, will not be available during pick-up, it is your responsibility to coordinate with the venue or to designate a responsible person to ensure all items are gathered together in the correct location.  IMPORTANT: All items must be replaced with the original and appropriate protective covering and transport bags or boxes.  

 

THRONE CHAIRS
Throne chairs must be delivered and picked up by Elevate The Cake to ensure proper care and protection of chairs during transport.  Renter agrees to use throne chair(s) for its proper use.  Renter agrees not to sit on the arms of chairs or allow others to do so to prevent damage.  Sharp objects, pens, pencils, markers, and clothing that leave stains (deep colors like red), will not be used on the throne chairs to prevent damage.  Renter agrees to clean immediately any spillage that may occur on chairs to avoid permanent stain or damage.  Renter agrees not to sublease or transport throne chairs to any other location after Elevate The Cake delivers Throne Chairs to the renter’s desired location.  Throne chairs are for one (1) day rental unless the renter pays for more than one day.


CAKE STANDS
Cake stands are three (3) day rentals.  Cake stands are covered and protected by bubble wrap and transported in a black nylon bag to prevent damage during delivery.  The original packing material as well as the black nylon bag must be returned with the stand.  Using the protective material will prevent potential damage.  If the original protective packing material is not returned with the cake stand, there will be a $10 replacement fee charged to purchase the proper protective material again.
Elevate The Cake expects some cake and icing residue, however, we ask that icing and crumbs be wiped off to prevent any staining on the stand (especially red velvet).  Elevate The Cake will do a thorough and professional cleaning of the stand when it’s returned.  Please do NOT use any liquids to clean stands!


POLICY AGREEMENT   
Answering yes on this website to have read the rental agreement is your signature and you agree to Elevate The Cake terms.


SPECIAL ORDER
Special customized items must be paid in full at the time of order. These orders may not be changed within six weeks of your event or once the products have been received/completed by Elevate The Cake.   Speciality names and cake toppers MUST be paid in full when the order is placed.  Speciality cake toppers and names are yours to keep.


SET-UP FEES
This fee includes the setup or installation of the rented item and/or applying only the decorations that WE PROVIDE. Fees are based on the total number of items, assembly time and decorating involvement.  We do not install or decorate with items that were not provided by us.  The set-up fee does not include breakdown, cleanup or removal. 


CLIENT SET-UP
If you opt to perform the set-up yourself, all rented items, including accessories and small parts, must be placed back into proper containers and cleaned, if necessary (for example: candles, candle holders, petals, table crystals, and vases). All vases, containers, boxes, totes, and packing materials must be returned to avoid replacement fees.  


LATE FEES
If items are returned late, the customer will be charged for an additional day. If items are not returned within three days and the customer can’t be reached, replacement fees will be assessed and charged to the credit card on file.  Communication is important!


PICK-UP RENTAL REQUIREMENTS
Rentals must be picked up in a secure vehicle.  A valid driver’s license for the driver, a credit card and ID from the cardholder must be on file.  Items must be returned on your due date to avoid additional charges.  Any items missing upon return are automatically charged for replacement or a late fee (additional day).  The client is to inform us upon arrival if something is damaged or missing.  Communication is important! 


Damaged/Missing Items
Renter assumes full responsibility of the item upon possession and agrees to pay the full replacement cost for lost or damaged items.  

PRICING POLICY
Rental Prices are subject to change without notice due to the season. Price quotes are valid for 14 days. Orders with special pricing must be booked by the date specified. All rental prices are non-negotiable. 


WEATHER-RELATED ISSUES
Elevate The Cake does not issue refunds for any reason, including inclement weather.  Should bad weather or wind become an issue, Elevate The Cake reserves the right to refuse or release such items due to risk of damage by inclement weather conditions.  The client assumes all risks and hardships involved with having an outdoor event.  Please discuss “Plan B” with your coordinator.  Elevate the Cake is not responsible for revising your event design the day or two prior to your event, should inclement weather ensue.  We desire that your event go as smoothly as possible.  However, if you choose to take a chance with the weather, the client assumes full responsibility for wind and weather damages.  If Elevate the Cake arrives for a delivery and the weather is bad or impending, we will call you or a contact person to discuss options.  Please always provide an additional contact name and number should you be unavailable on the day of your event.  

PAYMENT TERMS
Reservations and Payments are made online only via a secure payment system.  Elevate The Cake does not take phone orders or take payments in person.  The credit card will be used for reservations, damages, missing items, late fees, replacement fees, cleaning fees, or added services as outlined above.  The credit card will be charged if changes are made the day of the event, such as added services, labor or additional items are requested or required. CHECKS ARE NOT ACCEPTED!


DAMAGED/MISSING ITEMS
When you return your items after a 3-day rental time period, Elevate the Cake staff will check in the returned items, but is not responsible for checking for missing or damaged items. The owner of Elevate the Cake will do a thorough inspection of returned rented items and you will be notified by phone of any missing or damaged items within five (5) days. Elevate The Cake will notify you within five days of the event if damages are discovered, or items are found to be missing upon sorting, laundering and counting.  A detailed list of inventory will be given to you to sign.
 
Damaged items are discarded within 10 days unless the client requests to come pick them up. After 10 days, the client gives up rights to the item(s). Photos of damages will be submitted as proof upon request. If damaged items are not paid for within 7 days, the credit card on file will be billed, unless payment arrangements have been setup with the owner.

ORDERS/CHANGES
All order/service changes must be placed in writing or emailed as to avoid any confusion. A detailed invoice will be submitted following any changes to your order by email. Additional services require an appropriate payment and will be charged to your credit card unless other terms are specified. Emails are considered legal and binding and do not require a signature to be valid. If changes are made on the day of the event, a responsible party must sign for them upon delivery.  Your card on file will be charged for additions. Substitutions are allowed ONLY with a 14-day notice.  No substitutions are allowed within fourteen (14) days of the event.  Items may be allowed based on availability.  

CANCELLATIONS
Please be aware that once the contract is signed, and your event date scheduled, all other clients have been refused your specific rentals and services for your event date, and thus all payments are non-refundable. All services may be cancelled if received in writing no later than 30 days prior to the event. A credit in the amount of payment made will remain on file if the event is postponed.

PHOTOGRAPHY RELEASE
By signing this agreement, you give Elevate The Cake (ETC) permission to use the photos that we take at your event on our website and advertisements, materials, etc, with the understanding that you will not profit from them in any way.

NON-PAYMENT/BREACH OF CONTRACT
No services contained in this contract will be rendered, delivered, or available if Rental agreement is not signed and any balance not paid in full prior to your event.  
•    No payments will be accepted beyond the event date. No exceptions!
•    If payments are not received by the due date, and the credit card on file becomes invalid, expires, or we are unable to authorize it, your non-payment will be considered a breach of contract, and all previous payments are forfeited.
•    If rental agreement and payment is not received in a timely manner, ETC will consider your items held for rental and services available for another client’s use. ETC is not contractually obligated until rental agreement has been signed and payment has been made.  We will attempt to contact you using all phone numbers, email addresses and fax number. You will not receive a notice in the mail.  We understand that some things happen which are out of your control and we will work with you if you experience difficulty. It is possible to modify your contract, but it must be approved by ETC. Communicate with us!


SERVICE GUIDELINES
If you, your family members and friends are opting to decorate yourself, or use your own decorator, such person(s) are also required to abide by our guidelines, but you (the client) will be held responsible for damaged or missing items.

Cleaning/Preparation and Room Readiness
If, upon arrival, ETC discovers that tables, containers or other items require cleaning before we can properly setup your rentals, ETC will charge your account for cleaning and preparing the necessary areas/items. Or, ETC may have to simply drop off items and proceed to another event with no refunds being issued for paid set-up fees.  
•    Example 1 - If your facility provides the tables and chairs, and has agreed to set up the room, and it is not ready upon arrival, ETC may have to simply drop off the items and proceed to another event, and no refunds will be issued for paid setup fees. If time permits, we will setup items so that we may make an effort to perform our contractual obligation with you to complete the setup portion of your order.  Please provide a telephone number for your Coordinator or family member who is in charge on the day of the wedding to discuss these types of issues, should they arise. Your account will be charged for the additional labor without additional consent. (It is important for these details to be settled ahead of time) We cannot keep other clients waiting who have scheduled deliveries and setups.


Candelabras
Candles are rented separately.   Only drip-less or mechanical candles may be used on our candelabras. If candelabras are returned with wax residue, a $25 cleanup fee per candelabra will be assessed. 


Chair Covers
ETC is not responsible for damages resulting from improper use of chair covers. For example, chair covers can become crowded when too many chairs are placed around a table, and your guests will inadvertently step on each other’s chair covers or rip them when they get up.


•    Ensure Proper Fit - Please be sure of the style and size of the chair at your facility. Most banquet chair covers do not fit folding chairs, and vice versa. It is important to find out at least 90 days in advance about your chair style, so that we may reserve them out of our stock accordingly. If ETC discovers that the chair covers were used improperly, we will seek compensation for replacement of the damaged chair covers. This includes rips, snags, stains, and seams ripping etc.
   
•    Condition - Since ETC does have a strict damage policy, our chair covers are in new, excellent or good condition when rented to our customer. The condition of the cover depends on the length of service of the chair cover. Small discrepancies or shoe marks on the bottom of the chair cover are normal and you will not be charged for covers returned in good condition with minimal shoe markings. So understanding these rules, a tiny unnoticeable mark on the bottom part of your rented chair cover is considered good condition.


DAMAGED RENTALS
Wax Damage to Linens - If damage or stains occur which require extra cleaning, client will be notified and billed of such services within 10 days after the event. Such damages would include wax stains. This is the most common cause of damage to linens. All candles must be in a glass container or set on a mirror, candle stand, glass or protective cover to eliminate wax spills on the linen. No candles are to be placed directly on the linen without an appropriate holder. If burns occur, the item is considered damaged and must be replaced. If there is any wax stain(s) at all, even a small dot, the item will be considered damaged and will also need to be replaced. 
Ink Damage to Linens - Ink and marker stains will not come out, so please do not provide coloring books for children on tables that you have rented linens for. Butcher paper from the craft store is more appropriate. You can still create a centerpiece for the children’s table to tie it in with your other guest tables. 

Self Clean-up
All items must be free of debris and liquids before returning. Catering items, such as chafing dishes or others, must be rinsed before returning. Please discuss these services with your food provider. If the items are left in a full/dirty state, ETC will charge a fee of $25 per item. Deep cleaning of catering items is performed by using professional means and the items are not to be dismantled by you or your food provider.
Misuse of Items
Upon pickup or delivery, if ETC perceives that misuse will occur, we will NOT leave the items and no refunds will be issued.

Thank you for using Elevate the Cake for your special event!

You have chosen LIZ for your rental!  Liz is one of our most popular rentals!  She is covered in crystal rhinestone with a silver base enhancing her sparkle and opulence.

Liz is transported in a black nylon bag with bubble wrap and a protective cover to help prevent snagging from the crystal rhinestone chain links when removing and replacing the stand to and from the transport bag.  We ask that this protective covering is placed back onto the cake stand after use.  Doing so will help prevent damage that will incur additional fees.

We expect cake residue to be on the cake stand and Elevate The Cake will do a thorough cleaning upon the return of the stand.  However, we do ask that any excess icing or cake crumbs be wiped off as soon as possible to prevent staining.  Especially, Red Velvet!

Please take a look at the stand before taking to make sure that it is the stand you requested and that it’s in good condition. You agree to return the stand in good condition within the three day rental terms.  We understand that at times there are situations beyond your control, please communicate with us to avoid late fees.
